Title IX Protocol      



Lane College Sexual Harassment/Sexual Violence Protocol

  1. Listen to the accuser.

  2. Immediately notify either of the following persons:

  3. Upon notification, the Title IX Coordinator will dispatch Title IX investigator(s) to investigate the facts alleged in the complaint (whether verbal or written). Within 48 hours of the complaint being made, the investigator(s) shall initiate an investigation. No later than five days after the filing of the complaint, the investigator shall present his/her/their findings to the Title IX Coordinator, with a copy also being given to the Deputy Title IX Coordinator. The 5-day investigatory period may be extended for a reasonable time upon reasonable request of the investigator and in the discretion of the Title IX Coordinator or Deputy Coordinator. Immediately after the complaint is presented and pending the outcome of the investigation, a No Contact Directive will be issued to the accused, directing him/her to have no contact, whether directly or indirectly, with the accuser, nor intimidate, threaten, or otherwise interfere with the accuser, or make any attempt to engage in such conduct. "Have no contact" includes attempting to contact the accuser via phone, text, email, Twitter, Facebook, Instagram, SnapShot, or by the use of any other social media mechanisms. Furthermore, it includes attempting to contact the accuser through the intervention of other persons.

  4. Upon receipt of the findings of the Title IX investigator(s), the Coordinator and/or the Deputy Coordinator shall render a decision as to whether the accused, by a preponderance of the evidence, committed acts of sexual harassment toward the victim. The findings of the investigator and the decision of the Coordinator and/or Deputy Investigator shall be communicated to both the accuser and the accused. In the event that Coordinator and/or Deputy Coordinator rule in favor of the accused, the Coordinator and/or Deputy Coordinator shall impose an appropriate sanction against the accused in accordance with the allowed sanctions as written in the Lane College Students Handback. In the event that the Coordinator and/or Deputy Coordinator find(s) no basis or legitimacy to the accuser's complaint, the case shall be dismissed.

  5. In the event that the accused is found responsible for the infraction as alleged in the complaint, the accused will have five days to appeal the findings and/or imposed sanction in this matter to the Office of the President by providing written notice of intent to appeal. Likewise, in the event that the accused is found not responsible for the infraction as alleged in the complaint, the accuser shall have five days to appeal the findings and/or imposed sanction in this matter to the Office of the President by providing written notice of intent to appeal. In either case, the notice of appeal shall be filed with the office of the Dean of Students.
